This paper is an opinion letter designed for law school. The main legal issue surrounding this is whether the contract, made predominantly over e-mail, is legally enforceable or whether it is invalid based upon the statute of frauds. Generally, evidence of an electronic communication is admissible to indicate that a contract was made between the parties. However, based on the statute of frauds, a contract for real estate is not valid unless there is writing, which is specific, contains the essential elements of the contract, and is signed by the party to be charged.
